This Terms of Use applies to ushomerebate.com — a real estate brokerage — Licensed brokerage (operating on the Rebato platform). NAR member · State broker licenses listed at /disclosures.
These Terms of Use (the “Terms”) govern your access to and use of the websites, mobile applications, and services (collectively, the “Services”) operated by ushomerebate.com — a real estate brokerage (“we,” “us,” or “our”), operating on the Rebato platform across the United States. Our platform consists of four lines of business: a public listing marketplace, a licensed brokerage, an iBuyer inventory program, and a for-sale-by-owner (FSBO) support service.
By accessing the Services or creating an account, you agree to be bound by these Terms, our Privacy Policy, our Fair Housing statement, and our Disclosures. If you do not agree, you may not use the Services.
1. Acceptance of Terms
Your use of the Services constitutes acceptance of these Terms in full. We may amend these Terms at any time, effective upon posting to this page. Continued use after a change means you accept the change. Material changes (such as those affecting fees, the rebate program, or dispute resolution) will be highlighted at the top of this page for at least thirty (30) days.
2. Eligibility
You must be at least eighteen (18) years old and legally capable of entering into a binding contract under U.S. law. The Services are intended only for users located within the United States. You may not use the Services if you are barred from receiving services under applicable law, including U.S. sanctions law.
3. Accounts and Account Security
Some Services require an account. You agree to provide accurate, current, and complete information, to keep your account credentials confidential, and to notify us promptly of any unauthorized access. You are responsible for all activity that occurs under your account. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the platform or other users.
4. Listing Data, MLS Attribution, and IDX/VOW
Listing data displayed on the Services may be sourced from one or more Multiple Listing Services (“MLS”) under Internet Data Exchange (“IDX”), Virtual Office Website (“VOW”), or syndication agreements consistent with Real Estate Standards Organization (“RESO”) Web API standards. Each MLS-sourced listing is attributed to the originating MLS and listing brokerage in accordance with that MLS’s rules. Listing information is believed to be reliable but is not guaranteed and is subject to verification by all parties. Some information (for example, closed sale price or days on market) may be available only to registered users with active credentials. Photos and other media supplied through MLS feeds remain the property of the originating photographer or brokerage and may not be reproduced without permission.
5. Buyer Broker Agreement Requirement (NAR Settlement)
Following the National Association of REALTORS® (“NAR”) class-action settlement that took effect on August 17, 2024, our platform requires buyers to execute a written Buyer Broker Agreement (“BBA”) with their representing agent before any in-person showing, scheduled tour, or offer submission. The BBA discloses the scope of representation, the buyer-side compensation amount and source, and the agreement term. We enforce this requirement at the user-interface, application-programming-interface, and database layers. We will not bypass or waive this requirement.
6. Rebate Program and State-by-State Legality
For transactions in which the seller pays a buyer-side commission, ushomerebate.com may offer the buyer a fixed-fee rebate (the “Rebate Program”). Rebates are calculated by our internal Rebate Calculator using state policy in effect on the date of closing. Rebates are not available in states where buyer rebates are prohibited by statute or regulation. In states that require written disclosure or lender consent, rebate eligibility is conditioned on completion of the applicable disclosure form. Where a federally regulated mortgage is involved, the rebate must be disclosed to the lender in accordance with the Real Estate Settlement Procedures Act (“RESPA”) Section 8. Rebate amounts may be adjusted or withdrawn if the listing-side commission paid to Rebato, Inc. is less than the assumed amount, if the transaction does not close, or if any compliance condition is not satisfied.
7. Activity Fees
For transactions in which the seller does not pay a buyer-side commission, or in which the buyer engages us under a fee-for-service arrangement, we may charge an activity fee as agreed in the BBA. All fees, hourly rates, or flat amounts are disclosed in writing before any chargeable work is performed.
8. iBuyer and FSBO Services
Our iBuyer program purchases homes directly through a state-specific holding entity and resells those homes after inspection or renovation. iBuyer offers are estimates based on an automated valuation model (“AVM”) and are non-binding until both parties execute a purchase agreement. Resales are subject to the U.S. Department of Housing and Urban Development (“HUD”) anti-flipping rule at 24 C.F.R. § 203.37a and any applicable state-level rules. Our FSBO service provides tools and guidance only; we are not your agent in an FSBO transaction unless you separately engage us under a written listing or buyer agreement.
9. Acceptable Use
You agree not to (a) scrape, crawl, or bulk-extract listing data outside of our published APIs and the rules of the originating MLS; (b) reverse engineer or interfere with the Services; (c) submit false, misleading, or discriminatory listing content; (d) use the Services to send unsolicited communications; or (e) violate any law, including the Fair Housing Act and HUD advertising guidance at 24 C.F.R. § 100.75.
10. No Warranty; “As Is”
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, REBATO, INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LISTING DATA IS ACCURATE, COMPLETE, OR CURRENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, REBATO, INC. AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
12. Indemnification
You agree to indemnify, defend, and hold harmless Rebato, Inc. from any claim, liability, loss, or expense (including reasonable attorneys’ fees) arising out of your breach of these Terms, your violation of any law or third-party right, or any content you submit to the Services.
13. Dispute Resolution and Arbitration
Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, except that either party may bring an individual action in small-claims court. You and we waive any right to a jury trial and to participate in a class action. Arbitration shall take place in the county of your residence or, at your option, by video. This arbitration provision does not apply where prohibited by law.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles, except that the U.S. Federal Arbitration Act governs the arbitration provision. State-specific consumer-protection statutes continue to apply where mandatory.
15. Changes to the Services
We may add, change, suspend, or discontinue any feature of the Services at any time. We are not liable for any change or discontinuation, except as expressly required by law.
